Kourtney Kardashian's wellness brand, Lemme, is reportedly locked in a legal battle with a cigarette company from China that also goes by the name Lemme. For those not in the loop, Kardashian's Lemme focuses on vitamins and supplements, while the other Lemme deals in tobacco products, including cigarettes and e-cigarettes. According to insider information, Kardashian's team has filed an opposition to the cigarette company's trademark application.
Documents obtained by The Daily Mail reveal that Kardashian's Lemme is challenging the trademark application filed by Hong Kong Senran Technology Company. The gummies brand argues that there is a "priority and likelihood of confusion" and "dilution by blurring," which are cited as reasons for the opposition. The dispute involves goods ranging from cigarettes to electronic cigarette atomizers.
“Consumers have come to recognize LEMME as identifying the source of high-quality vitamins and vitamin supplements that originate from Opposer [Kardashian’s brand],” the documents state.
Kardashian's team is concerned that any dissatisfaction with the Chinese brand's products could harm the reputation of Kardashian's Lemme. They argue that the Hong Kong brand could "dilute" and "tarnish" the famous Lemme mark. However, the Hong Kong company has fired back, denying that Kardashian's brand will sustain any damage.
The company asserts that Kardashian's Lemme hasn't proven its fame in the U.S. market under the Lanham Act. They also argue there's no confusion between the two brands due to the significant differences in their product lines and market channels.
As both parties prepare for what could be a lengthy legal process, the outcome of this trademark dispute could set a precedent for similar cases involving brand names in different industries. For now, both Kourtney Kardashian and Hong Kong Senran Technology are firmly standing their ground, each hoping the law will be on their side.
